ATTENTION: Please read the following rules and regulations governing Fantazzle's High Stakes Fantasy Football League held at SuperDraft 2010. Fantazzle's High Stakes Fantasy Football Leagues held at SuperDraft 2010 are games of skill that offer guaranteed cash awards to participants. Participants all agree to take part in an activity whose outcome is based on participants' skills and abilities in judging the potential performances of NFL players over an extended period of time. Participants' skills extend to judging how an NFL player's performance relates to the rules and scoring system that govern Fantazzle's high stakes fantasy football leagues.
Fantazzle's high stakes leagues will hold live drafts in Las Vegas, NV at the Palms Hotel on August 28th. Participants who choose to stay at the Palms Hotel and attend any or all of the SuperDraft 2010 events shall not hold Fantazzle responsible for any loss or destruction of property, or bodily injury incurred during their stay at the Palms Hotel or while attending any SuperDraft 2010 events.
The high stakes fantasy leagues are open to individuals who are at least twenty-one (21) years of age. Notwithstanding the foregoing, eligible legal residents of the following states are not eligible to win any prizes: Arizona, Iowa, Louisiana, Maryland, Montana, North Dakota and Vermont. Employees of Fantasy Judgment, or its respective parents, subsidiaries or affiliates, and immediate family members, are not eligible to participate in any of Fantazzle's high stakes fantasy football leagues.
Fantazzle's High Stakes Fantasy Football Leagues do not and will not officially recognize any co-manager or co-drafter. If a selected participant wishes to delegate responsibility for managing or drafting their team, that decision is made solely at the participant's discretion and Fantazzle will not be held liable for any actions undertaken by a co-manager or co-drafter. However, Fantazzle will provide space for one co-manager at the high stakes fantasy football draft for a $50 fee. Additionally, there is also a $125 cover charge necessary for co-managers to enter SuperDraft. Co-Managers are considered guests of the principal participant and have no legal standing with Fantazzle. Fantazzle is not responsible for any changes made to the roster or starting lineup by third parties or co-managers who access the participant's high stakes fantasy football website.
Once a participant signs up for the Contest on the Site and submits valid payment, no entry fees will be refunded unless the Contest or the participant's League is canceled, in which case the participant will receive a full refund.
Michael A. Stein, Esq. of Fantasy Judgment will serve as the Commissioner of each Fantazzle High Stakes Fantasy Football League. The Commissioner will oversee all aspects of the draft and be responsible for resolving any issues that may arise during the season. Fantasy Judgment reserves the right to correct any unforeseen loophole that is not addressed in the rules. All rulings by Michael A. Stein, Esq. and Fantasy Judgment are final.
The League season will run for seventeen (17) weeks beginning with Week 1 of the NFL regular season and ending with week 17 of the NFL season. The league games officially begin on Thursday, September 9, 2010.
The draft order of each participant will be chosen randomly by Fantasy Judgment and announced and overseen by www.fantasyjudgment.com, an independent agent. Fantasy Judgment will use the random draft generator at fftoolbox.com to randomize the draft order. Participants will be notified of their draft spot before the draft begins. Trading or swapping of draft picks or draft order is not allowed.
A player cannot be promoted to the starting lineup or benched for a given week after the scheduled kickoff of that player's game for that week. If a starting lineup is not submitted, then the previous week's starting lineup will be used. If a starting lineup is not submitted in Week 1, then the Commissioner will set the starting lineup with the highest drafted players at each position who are not injured. All participants and any of their co-drafters must sit in their assigned draft order.
Fantazzle will hire CBS Sports as the official league management service to keep track of all league scheduling, free agent transactions, starting lineup submissions, fantasy point calculations, won-lost records, standings, and playoff rankings. This commissioner service can only be changed by a majority vote of league members on or before August 23, 2010.
Any and all scoring discrepancies affecting a team must be noted and submitted via email to the Commissioner by 12 noon ET on the Thursday following the completion of that week's games. After 12 noon ET on Friday of any given week, all scores will be considered final, unless the league commissioner notes a change in the official statistics (as kept by the Elias Sports Bureau) of any player for the last game played. It will be up to the sole and absolute discretion of the commissioner as to whether a change in the official statistics of a player can reasonably be applied to amend the ranking or scoring of any or all teams potentially affected by the change in a player's statistics.
Any disputes, issues, conflicts or appeals regarding these rules will be decided by Fantasy Judgment using its interpretation of the rules. Any and all disputes or appeals must be submitted via email to the Commissioner. The deadline for submitting a Rules dispute or appeal is by 12 midnight ET on the Thursday following the completion of that game or games in which the dispute has occurred. Please include a detailed account of the dispute and resolution requested. All rulings made by Fantasy Judgment are final and binding.
All award money will be paid in U.S. dollars by January 15, 2011. If you are required to sign an affidavit of eligibility and liability release, please allow 30 days from the time your signed affidavit and release is returned. All taxes associated with the receipt of any award are the sole responsibility of the winner. Any interest accrued to award money does not convey to the award winner. Fantazzle will distribute cash awards directly to each winning participant and only the principal participant. Fantazzle is not responsible for, or bound by, any agreement between the principal participant and any third parties regarding apportionment of the awards.
Potential prize winners will be notified by email within seven (7) days after the final league standings are determined at the conclusion of the season, which email shall include an affidavit of eligibility and publicity/liability release. The conclusion of the season is defined as 12:00 PM EST on the Wednesday following the last day of competition in the League. Except where prohibited by law, a prize winner's acceptance of a prize constitutes permission for Fantazzle to use the prize winner's name, photograph, likeness, statements, biographical information, voice, and address (city and state only) worldwide and in all forms of media, in perpetuity, without further compensation. Participants agree to Fantazzle's use of their names and likeness for advertising and publicity purposes, without additional compensation, unless prohibited by law.
All league participants agree to conduct themselves in a civil manner. The league is designed to promote competitive gamesmanship among participants. Personal attacks or criticisms of other league participants will not be allowed. The league message board and email are provided to facilitate communication between league participants. Fantazzle does not permit posting or sending of messages or images, including logos and avatars, that could be considered offensive to other participants. Fantazzle, in its sole discretion, may disqualify any participant from participating in a league (without a refund), refuse to award points or a prize, and require the return of a prize, if participant engages in any conduct that Fantazzle deems to be improper, unfair or otherwise adverse to the operation of the contest or league or detrimental to other participants. All decisions by Fantazzle and Fantasy Judgment are final.
SuperDraft, Fantazzle, Fantasy Alarm, Fantasy Judgment, Fantazzle High Stakes Fantasy Football Leagues, and their respective parents, affiliates and subsidiaries assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, any errors and/or ambiguity relating to the contest and leagues, any related advertising or promotions, and/or these rules, including but not limited to errors in the announcement of a prize winner or the distribution of a prize. In the event of any ambiguity(s) or error(s) in these rules, Fantazzle reserves the right to modify these rules for clarification purposes or to correct any such ambiguity or error(s) without materially affecting the terms and conditions of the contest. Fantazzle reserves the right to halt or modify the contest or any league at any time during the season if events beyond its control compromise the contest or league's fairness or integrity. In the event that a scheduled NFL game is canceled or preempted for any reason, no points will be awarded for that week for players on the affected NFL teams. Fantazzle is not responsible for typographical or other human or technical errors in the offer or administration of the leagues, including but not limited to errors in advertising, the rules, the announcement of a winner, or the distribution of a prize.
Superdraft, Fantazzle, Fantasy Alarm, Fantasy Judgment, Fantazzle High Stakes Fantasy Football Leagues and their respective parents, affiliates and subsidiaries are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email entry or transaction to be received on account of technical problems or traffic congestion on the internet or at any web site, or any combination thereof, including any injury or damage to any participant's or any other person's computer related to or resulting from participation in a league. Fantazzle is not responsible for any problem or technical malfunction which impedes or interferes with the transmission or receipt of any team transaction, including but not limited to free agent moves, or starting lineup submissions. Fantazzle is not responsible for the failure of any telephone network or lines, computer online systems, servers, equipment or software, or traffic congestion on the Internet or at any web site, phone lines, or any combination thereof, including any injury or damage to a participant's computer related to or resulting from participation in the high stakes fantasy football league.
If for any reason, the high stakes league is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Fantazzle, then Fantazzle reserves the right to modify the rules or suspend the high stakes league. Fantazzle assumes no responsibility for any error, omissions, interruption, deletion, defect or delay in operation with transmission, communications, line failure, theft, destruction or unauthorized access to the league management website.
Any participant who colludes in an effort to alter the standings, rankings, or fantasy point totals will be prohibited from winning any award money and will further have their teams taken over by a surrogate or agent of Fantazzle. Any participant or co-manager acting on behalf of a participant who attempts to bribe, coerce, blackmail or otherwise influence an officer, agent, affiliate, vendor or surrogate of Fantazzle in an effort to alter the standings, rankings, or fantasy point totals will be prohibited from winning any award money and will further have his or her team taken over by a surrogate or agent of Fantazzle.
Participants are expected to manage their team to the best of their ability for the duration of Fantazzle's High Stakes Fantasy Football League season. However, Fantazzle recognizes that some teams will abandon their effort to compete during the season. This might include the failure to alter or turn in lineups or the failure to pick up free agents, etc. Fantazzle will regard such behavior as detrimental to the league and will utilize its discretion to start the best available players on any team considered to be abandoned. A team shall be considered abandoned if its lineup has not been changed for two weekly scoring periods or more. It is the responsibility of the participants in the event to notify Fantazzle of competitiveness issues. Additionally, Fantazzle reserves the right to intervene in team management when it considers a principal participant to be involved in malicious, willful or deliberate manipulation of the event.
Fantazzle will communicate regularly as a commissioner with all leagues throughout the course of the season. However, Fantazzle shall consider a team abandoned if a team lacks a valid starting lineup (consisting of active players for a full lineup) and no attempt is made to rectify the situation over a two-week period. During the two-week period, Fantazzle will attempt to contact the owner using all available contact information on file. It is the owner's responsibility to notify the Fantazzle High Stakes Fantasy Football League commissioner of a situation that prohibits the owner from managing their team for an extended period of time. Absent this notification to Fantazzle, the owner risks relinquishing their team's general management function to Fantazzle. This does not include ownership of the team.
Once a team has been declared abandoned or a participant has violated the rules herein to the extent that their actions constitute suspension from the league, Fantazzle will assume general management of the participant's team. General management includes the ability for Fantazzle to make weekly lineup changes. Should a team be declared abandoned, owners in the league will be notified via the league's event news and also by email. Fantazzle's high stakes fantasy football league commissioner will optimize said owners lineup with eligible players with the highest points earned to date in the high stakes league. If there is more than one player with equal points earned year to date, the player drafted earliest in that league draft or acquired for the most free agent dollars in that league will be the player started. If, due to byes, an abandoned team cannot fill out a full starting lineup, then Fantazzle will assume waiver wire responsibilities for the team and add the highest scoring free agent player at that position while dropping a player at the same position who is the lowest scoring player at that position on the abandoned team's roster.
Participants have read and fully understand the terms of this release, and further understand that they have given up substantial rights by e-signing their application and submitting their registration to Fantazzle's High Stakes Fantasy Football League. Participants acknowledge that they have signed it freely and without any induction or assurance of any nature and intend it to be complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force.
